HORROR-WEB TERMS OF SERVICE   
Horror Web's Terms of Service (TOS) are very simple:

1. Like most TOS's, we offer what we have here, nothing more nothing less =)

2. Like most TOS's we expect you to accept our TOS if you wanna play at, hang around, or be part of the Horror-Web

3. We do wish you to given current/accurate information, BUT we do not require you to give 'real life' information in any of the public forums...if you prefer to use online names only, that's fine, just make sure that your email is correct. This is especially important for prize notification for various contests and those 'whims' we've been known to go on and just give stuff away =) However, we do not tolerate doppelgangers, lying, or otherwise providing false personalities. One persona per schizo please...

4. Horror-Web is pg13. By MPAA definitions that means: "Parents Strongly Cautioned. Some Material May Be Inappropriate For Children Under 13." By Horror-Web definitions pg13 breaks down to two things: intension and intensity.

We understand that the genre [horror] is full of violence, swearing, blood, guts, demons, etc. but also know that you can watch, discuss, and recommend on a pg13 level. Even if what we're discussing is not pg13, there is no reason we can't be. Why do we do this? Because the genre should be for everyone - young and old. If we go beyond the pg13 rating, some may not be able to get into the site because of parental controls, etc. It is also a more mature, dignified, and professional way to present oneself. How does 'intention' and 'intensity' break down, you ask?

  • INTENTION: Swearing, sexuality, and violence used to shock, disrespect, anger, flame, or otherwise alarm other members in such a way as to make them uncomfortable intentionally, or to disrupt the group, discussion, chat, etc. is unacceptable.
  • INTENSITY: Referring to sexuality or the act of intercourse in a mature, responsible fashion - as well as, the occasional cussing in adjective or expletive form, not aimed AT another is understandable and acceptable. When it becomes graphic, habitual, or unnecessarily vulgar it is unacceptable.

    Please use taste and tact in your postings, listings, and websites that are associated with the Horror Web. The Horror Web DOES reserve the right to remove sites from our programs that we feel are inappropriate or overly grotesque. If you question your site's appropriateness just E-mail HorrorWench.

    5. Accounts, passwords, and security: upon joining any of our various programs/areas you will receive emails or online instructions. You are responsible for maintaining this information for yourself, as many of our areas are hosted remotely and we do not have access to them in such a manner as to retrieve your information for you.

    6. Member Conduct: go read Yahoo!'s, or any other TOS and you'll see what is and is not acceptable for member conduct. Basic rundown? You agree to NOT
    1. upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, torturous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
    2. harm minors in any way;
    3. impersonate any person or entity, including, but not limited to, Horror-Web staff or members, or falsely state or otherwise misrepresent your affiliation with a person or entity;
    4. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted;
    5. upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
    6. upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
    7. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation - except in the form of press releases and such, which should be sent to the appropriate persons:

      • Unimonster: ALL news/rumors
      • Jekyll: Indie Film reviews, awards
      • HorrorWench: Contests, promotions, book reviews, & everything else =)
    8. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
    9. disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;
    10. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
    11. intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;
    12. "stalk" or otherwise harass another; or
    13. collect or store personal data about other users.

    7. Contests are a big part of HorrorWeb and we are happy to do the work so that you may reap the rewards. The rules/regulations for all contests on our site, whether hosted on our server or by a third party, are as follows:
  • One entry per person, per contest - multiple entries will be discarded
  • Answers to True/False, Multiple Choice, and Fill in the Blank are determined before the contest opens - those are the answers that will be used unless a valid answer is given and a majority vote accepts it
  • Invalid information in forms will result in discarded entries or 'next in line' winners
  • Ties will be decided either by random drawing or by date of entry, dependant upon contest difficulty and staff/contributor preference
  • One win, per person, per 30 day time period for any and all contests on HorrorWeb, unless otherwise noted

    8. The all important 'protect your butt' INDEMNITY: You agree to indemnify and hold Horror Web, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post to or transmit through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

    9. You are not authorized and hereby agree not to sell, resell, reproduce, duplicate, copy, or exploit for any commercial/private purposes any portion of Horror Web.

    10. The Horror Web reserves the right to, at any time and from time to time, to modify or discontinue (temporarily or permanently) any services, or areas. You agree that Horror Web shall not be liable to you or to any third paty for any modification, suspension, or discontinuance.

    11. You agree that Horror Web, in its sole discretion, may terminate your password, account, or any part thereof and remove/discard any content you may have on or connected to Horror Web, for any reason including but not limited to, TOS violation.

    12. Horror Web may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Horror Web has no control over such sites and resources, you acknowledge and agree that Horror Web is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Horror Web shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

    13. And FINALLY, you agree to have a good time at all times and share your love, knowledge and great sites with the rest of us at the Horror Web!! =)
